Please be advised that I represent TLA Releasing, and am writing to advise you of a potential infringement of our license for the DVD motion picture entitled “Rapturious” (hereafter, "Picture"), for which we have licensed the exclusive video distribution rights.



It has come to our attention that your website hosts or contains numerous images from the Picture, including, without limitation, images of some of the individuals involved in the Picture. The use of these images is without permission or authorization of any manner. This use is in violation of copyright, rights of publicity, and exclusive right to the images from the Picture; in particular, but without limitation, this use violates our rights under the United States Copyright Code, 17 U.S.C. Section 101 et seq. To the extent that some of the images contained on the website are not owned by us, it is also likely that this use of those other images violates the rights of the copyright holders of those images. We believe in good faith that the disputed use is not authorized by us as the Distributor, or by the copyright owner, its agent, or the law and we do assert, under penalty of perjury, that the above information is accurate, and that we are authorized to act on the copyright owner's behalf.



This letter orders you immediately to cease and desist from using or otherwise permitting the use of any images from or associated with the Picture. You shall immediately remove all such images from the Website and any affiliated websites you operate, own or control.



This letter is not a full recitation of all of the facts or legal grounds that support our rights. All of our rights and remedies are expressly reserved and retained without limitation, prejudice or waiver.



I would appreciate a response to this letter as soon as possible, and would request to be apprised of any results of investigations on your part with respect to this claim. Thank you in advance for your cooperation and courtesy in this matter.
